Terms of use
1. Introduction
These terms of use govern the use of the Romy SaaS platform, published by Romy SAS for hospitality professionals.
By using Romy, the Client accepts these terms without reservation.
2. Purpose and scope
Romy offers two modules:
- Guest Communication via WhatsApp: AI agents for guest messaging, upselling, multilingual assistance and post-stay review collection;
- Review Intelligence: review aggregation, AI-drafted replies, analytics and publishing.
3. Access to the platform
Access requires an administrator account and is reserved for professionals (B2B). The Client is responsible for keeping its credentials confidential and for the access it grants to its users.
4. Acceptable use
The Client agrees to comply with applicable laws and with Meta and WhatsApp Business policies. Spam, unlawful content and circumventing technical limits are prohibited.
Romy may suspend an account in the event of clear abuse.
5. Data and privacy
The Client remains the owner of its data. Romy may anonymise sensitive data for AI purposes; personal data is not used to publicly train external models.
Romy acts as a data processor within the meaning of the GDPR. A data processing agreement (DPA) is available on request. Romy supports the Client with data deletion and portability.
To learn more, see our privacy policy.
6. Integrations
The Client must hold a compliant WhatsApp Business API account and bears all fees charged by Meta.
Review platforms are connected through official or authorised APIs; some features require specific validation by the Client. The Client remains responsible for access to its PMS.
7. Pricing and payment
Romy is provided on a subscription basis, possibly with variable fees (for example per room or linked to WhatsApp costs). Billing starts at activation or go-live, as set out in the contract.
In the event of non-payment, access may be suspended after a reminder.
8. Service availability
Romy targets 99% availability, excluding planned maintenance, incidents involving third-party services and force majeure.
9. Liability
Romy cannot be held liable for:
- operational decisions made on the basis of its analyses;
- sanctions applied by WhatsApp due to the Client’s non-compliance;
- incorrect information provided by the Client to its AI agent.
The AI assists teams but does not replace human judgement.
10. Term and termination
The subscription runs on a monthly or annual basis. The Client may terminate under the notice terms set out in the contract. Romy may terminate in the event of a breach, abuse or serious failure by the Client.
11. Intellectual property
The platform, its interfaces, AI models and content are the property of Romy SAS. The Client is granted a non-exclusive licence of use.
12. Changes to these terms
Romy may amend these terms. The Client will be informed and may terminate its subscription if it disagrees.
13. Governing law
These terms are governed by French law. Any dispute falls under the jurisdiction of the courts of Paris.
